1. Who we are

ATW Distributors Ltd. (“ATW Distributors”, “we”, “us” or “our”) operates http://www.atwdistributors.com (the “Site”). This Privacy Policy explains what personal information we collect through the Site, how we use and protect it, and the choices you have. We handle personal information in accordance with Alberta’s Personal Information Protection Act (PIPA) and, where it applies, the federal Personal Information Protection and Electronic Documents Act (PIPEDA).

2. Information we collect

Information you give us. When you use our contact form, email or call us, we collect what you choose to share, such as:

• your name;
• email address and phone number;
• company or dealership name; and
• the content of your message, including any vehicle or product details.
Information collected automatically. When you visit the Site, we and our service providers may automatically collect technical information, such as your IP address, browser and device type, the pages you view, how you arrived at the Site, and the date and time of your visit. This is collected through server logs and cookies (see section 10).

We do not knowingly collect sensitive information such as financial, health or government ID information through the Site. Please do not send it through our forms.

3. How we use your information

We use personal information to:

• respond to your inquiries and provide the product information, quotes or support you ask for;
• follow up on your request and maintain a record of our communications;
• operate, secure and improve the Site, including understanding how visitors use it;
• send you marketing emails, but only where you have consented (see section 5); and
• meet our legal, regulatory and accounting obligations.

We only collect and use personal information for purposes a reasonable person would consider appropriate in the circumstances.

4. Consent

By submitting information through the Site or contacting us, you consent to our collection, use and disclosure of that information for the purposes described in this Policy. You may withdraw your consent at any time, subject to legal or contractual restrictions, by contacting us (section 13). If you withdraw consent, we may not be able to respond to your inquiry or provide certain information.

5. Marketing emails

We will only send you commercial electronic messages, such as newsletters or promotions, where you have given consent or where Canada’s Anti-Spam Legislation (CASL) otherwise permits it. Every marketing email will include a working unsubscribe link, and you can also opt out by contacting us.

6. How we share information

We do not sell or rent your personal information. We share it only:

• With service providers who help us run the Site and our business, such as website hosting, email, form handling and analytics providers. They may only use the information to provide services to us and must protect it.
• With manufacturers or partners, where needed to answer your product or warranty inquiry, and only with your knowledge.
• For legal reasons, where required or permitted by law, such as to comply with a court order or protect our rights.
• In a business transaction, such as a sale or merger of our business, where the information is needed to complete the transaction and remains subject to privacy protections.

7. Storage outside Canada

Some of our service providers, including HubSpot, Brevo, may store or process personal information outside Canada, including in the United States. When that happens, the information is subject to the laws of that country and may be accessible to its courts, law enforcement and national security authorities. You can contact our Privacy Officer (section 13) for information about our policies and practices for service providers outside Canada, or to ask questions about how they handle your information.

8. How long we keep information

We keep personal information only as long as reasonably needed for the purposes it was collected for, or as required for legal or business purposes. Contact form inquiries are generally kept for two years after our last communication with you, then securely deleted or anonymized.

9. How we protect information

We use reasonable physical, administrative and technical safeguards to protect personal information against loss, theft and unauthorized access, use or disclosure, including encrypted (HTTPS) connections on the Site and restricted access to inquiry records. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

10. Cookies

Cookies are small text files stored on your device when you visit a website. The Site uses:

• Essential cookies that make the Site and its contact form work properly and securely.
• Analytics cookies from Google Analytics that tell us, in aggregate, how visitors find and use the Site so we can improve it.
• Marketing cookies from Meta Ads that help us measure and show relevant ads.

You can block or delete cookies in your browser settings, and you can opt out of Google Analytics with Google’s browser add-on. Blocking essential cookies may stop parts of the Site from working.

11. Your rights

You may ask to access the personal information we hold about you and ask us to correct it if it is inaccurate or incomplete. To make a request, contact our Privacy Officer (section 13). We will respond within the time required by law, typically 45 days, and may need to verify your identity first.

If you are not satisfied with our response, you may contact the Office of the Information and Privacy Commissioner of Alberta (oipc.ab.ca).

12. Other things to know

• Children: The Site is intended for adults and businesses. We do not knowingly collect personal information from children under 13.
• Other websites: The Site may link to manufacturer or social media sites. Their privacy practices are their own, so please review their policies.
• Changes: We may update this Policy from time to time. The updated version will be posted on this page with a new effective date.
